These Terms of Service (“Terms”) set forth the rights, obligations, responsibilities, and other necessary matters between Finola (hereinafter the “Company”) and its members (“Members”) regarding the use of all online and mobile services (collectively the “Services”) provided by the Company.

  1. Services: All functionalities, content, and systems provided by the Company through websites, mobile applications, APIs, and other platforms.

  2. Member: An individual who agrees to these Terms and enters into a service agreement with the Company to use the Services.

  3. Snack: A form of virtual credit that Members can purchase for a fee to use within the Services.

  4. Content: Any text, images, videos, files, links, or other information created, posted, or transmitted by Members in the course of using the Services.

  5. Paid Services: Certain features or services that require payment, either through Snack or other payment methods, to be accessed.

Article 3 (Posting and Amendment of the Terms)

  1. The Company shall post these Terms on the Service’s main page (or a linked page) so that Members can review them easily.

  2. The Company may amend these Terms to the extent that such amendments do not violate applicable laws.

  3. If the Company amends these Terms, it will announce the effective date and the reason for amendment at least seven (7) days prior to the effective date (or thirty (30) days if the changes are significant or disadvantageous to Members). The announcement will be made along with the previous Terms.

  4. If a Member does not agree with the amended Terms, the Member may terminate the service agreement and discontinue use of the Services.

  • Matters not specified in these Terms or interpretations thereof shall be governed by relevant U.S. federal and state laws, regulations, and commercial practices.

  • The Company may establish separate guidelines or policies for specific Services. In the event of a conflict between such guidelines and these Terms, the guidelines shall prevail.

  1. The service agreement is formed when an individual (“Applicant”) applies for membership by following the procedure set by the Company (including agreeing to these Terms) and the Company approves the application.

  2. The Company may refuse or terminate the agreement if:

    1. The Applicant has previously violated these Terms and had the agreement terminated;

    2. The Applicant uses another person’s identity or provides false information;

    3. Other reasons deemed necessary by the Company (such as technical or operational difficulties).

  3. The Company may postpone approval if there is insufficient capacity or a technical or operational issue.

  • Members shall promptly update any changes to their personal information through the method designated by the Company or by contacting customer support.

  • The Company shall not be liable for any disadvantages caused by the Member’s failure to update personal information.

  1. Members shall not allow any third party to use their account or password.

  2. If a Member discovers that their account or password is being used by a third party, they must immediately notify the Company and follow the Company’s instructions.

  3. The Company is not liable for damages caused by a Member’s negligence regarding account and password management.

  1. The Company provides various functionalities related to Finola (blog/content creation, Snack purchase, etc.).

  2. The Company may modify all or part of the Services for operational or technical reasons and will announce significant changes in advance unless unavoidable circumstances require a post-announcement.

  1. Snack is a virtual credit that Members can purchase for a fee using the payment methods specified by the Company (credit card, digital wallet, etc.).

  2. Snack can only be used for certain features within the Services (e.g., content creation aids, premium upgrades, analytics).

  3. Snack cannot be transferred, lent, or used as collateral to any third party and is not redeemable for cash.

  4. Snack is non-refundable upon membership cancellation or forced termination (due to violation of these Terms or Company policy).

  1. Certain parts of the Services may be fee-based (“Paid Services”). Members may use Snack or other payment methods to access Paid Services.

  2. Specific details about payment methods, pricing, and refund policies for each Paid Service will be provided on the relevant service page.

  3. While the Company strives to ensure stable access to Paid Services, it shall not be liable for service suspension due to force majeure events (natural disasters, system failures, etc.). However, the Company will make reasonable efforts to restore service and minimize Member inconvenience in such cases.

  1. No refunds will be provided for Snack purchases made by Members who decide to cancel or terminate their membership.

  2. If the Member is unable to use the Paid Services due to the Company’s fault (e.g., prolonged service outage), the Company may offer refunds, compensation, or extensions for the Paid Service period as appropriate.

  3. All refunds, if any, will be processed in accordance with applicable laws and the Company’s internal policies.

  1. Members shall not engage in any of the following acts:

    1. Illegally using another person’s identity, providing false information, or committing payment fraud

    2. Infringing on the copyrights, trademarks, or other intellectual property rights of the Company or third parties

    3. Posting or disseminating obscene, violent, hateful, or unlawful content

    4. Disrupting the normal operation of the Services or illegally accessing the Company’s systems

    5. Violating any applicable laws or these Terms, or any policies established by the Company

  2. Members shall comply with all notices, usage guidelines, and other instructions provided in connection with the Services.

  1. The copyright to any Content uploaded or posted by Members within the Services remains with the Member.

  2. The Company may use such Content for promotional or operational purposes without additional compensation, provided it does not violate the Member’s personal rights (e.g., personal information).

  3. If the Company wishes to use the Content for commercial purposes beyond the scope stated above, it shall obtain separate consent from the Member in advance.

  1. If any Content posted by a Member is deemed illegal, obscene, defamatory, or in violation of these Terms or Company policies, the Company may remove or modify such Content or restrict the Member’s account without prior notice.

  2. In accordance with applicable laws and Company policies, the Company may store and delete posted materials after a certain period.

  1. The Company shall establish and disclose a Privacy Policy to protect Members’ personal information and handle it safely in accordance with applicable laws.

  2. The Company collects and uses personal information in a minimal manner, distinguishing between the information that requires separate consent at the time of sign-up and the additional information that may be required during the Service usage.

  1. If a Member violates these Terms or disrupts the normal operation of the Services, the Company may, without prior notice, revoke membership, suspend use, remove posts, or take other actions.

  2. The Company shall not be liable for any losses resulting from such actions, and the Member is not entitled to request refunds for any unused Snack.

  1. Members may terminate the service agreement at any time by using the “Cancel Membership” feature within the Services or by contacting customer support. The Company will process such requests in accordance with applicable laws.

  2. Upon cancellation, the Member’s posts or comments may remain (or be anonymized) if necessary for the continued operation of the Service or as required by law.

  3. Members shall be solely responsible for any disadvantages caused by cancellation, and the Company provides no compensation for canceled memberships.

  1. The Company shall not be liable for any failure or delay in providing the Services due to force majeure events such as natural disasters, war, terror, hacking, or communication failures.

  2. The Company is not responsible for any Service usage failures caused by the Member’s own negligence or fault.

  3. The Company does not guarantee that Members will achieve any specific outcome, profit, or benefit from using the Services, nor does it guarantee the accuracy, reliability, or completeness of information provided within the Services.

  1. The Company is not obligated to intervene in disputes arising between Members or between a Member and a third party, and it is not liable for any damages resulting from such disputes.

  2. If a Member engages in transactions based on any content, advertisements, or links posted within the Services, the resulting dispute is solely between the Member and the third party. The Company bears no responsibility for any damages or liabilities arising from such transactions.

  1. All software, images, designs, logos, trademarks, service marks, and other intellectual property related to the Services are owned by the Company.

  2. Members may not, without prior permission from the Company or relevant right holders, copy, transmit, distribute, modify, sell, rent, display, or otherwise exploit such intellectual property for commercial or other unauthorized purposes.

  1. Members may not assign, transfer, grant as collateral, or otherwise dispose of their right to use the Services, or any contractual status, to any third party without prior consent from the Company.

  2. If the Company merges or transfers the Services to another entity, the Company will notify Members in advance of such changes.

  1. In the event of a dispute between the Company and a Member, both parties shall make good faith efforts to resolve the dispute amicably.

  2. If a lawsuit arises from the dispute, the court with jurisdiction over the Company’s principal place of business shall have exclusive jurisdiction.

  1. These Terms shall be governed and construed in accordance with the laws of the United States and any relevant state laws where the Company is located or registered.

  2. The Company may have separate terms for other regions (e.g., South Korea), and shall comply with local laws and regulations as necessary.

  1. The Company may establish separate operational policies (FAQs, guidelines, etc.) for specific details not set forth in these Terms. Such policies will be posted in the Service’s notices or on the Company’s official website/app.
